Calculations for the capacity of the <br />current and proposed spillway are presented in Appendix 6. <br />To summarize, several maintenance and regulatory upgrades are required for both the <br />LEDE Ditch and LEDE Reservoir as follows: <br />a) The existing spillway needs modification to ensure compliance with <br />applicable regulatory criteria. <br />b) The current dam needs to be raised additional 5 feet to meet current dam <br />safety free board requirements, and the dam crest needs to be widened to <br />the required minimum of 20 feet. <br />c) The outlet pipe requires rehabilitation to meet the design requirement of <br />reducing the water levels in the dam by 5 feet over 5 days. <br />d) The dam outlet gate and trash rack may need to be replaced due to their <br />age (78 years), wear and signs of rust. <br />e) The LEDE ditch has an inadequate head gate. <br />fl The existing 860 feet of piped ditch is in need of maintenance at the joints. <br />g) The ditch embankment has been over topped in several locations due to <br />ice dams that remain late into the spring due to the ditch being on the <br />shady side of the mountain and it flows through a thick conifer forest. <br />Additional piping with 30" diameter HDPE through this area is <br />recommended. <br />2.4.1 Analvsis of Alternatives <br />a. Institutional Requirements. <br />Regardless of the alternative chosen, the following institutional requirements will require <br />consideration. <br />i. Forest Service Permitting. Currently, the LEDE Ditch and LEDE <br />Reservoir are operated on Forest Service Lands. The Forest Service has issued a <br />special use permit to Gypsum for the LEDE Ditch and LEDE Reservoir, which <br />expires on December 31, 2036. Currently, an old roadway around the reservoir <br />and up to the ditch have been blocked by the Forest Service for access, although <br />Gypsum's special use permit allows for access. Specifically, the special use <br />permit provides for operating and maintaining the entire LEDE Ditch and <br />Reservoir within a specific area. All of the alternatives can occur within the <br />defined permit area. However, while the permit area (approximately 31 acres <br />associated with the reservoir and dam, and approximately 2,800 lineal feet <br />associated with the ditch) and access area is adequate to accomplish any of the <br />alternatives described, the permit contains limitations that could require permit <br />amendment. Even absent any need for amendment, the current permit requires <br />that all development plans be provided to the Forest Service prior to any <br />construction. Therefore, funds will be required for Gypsum to ensure that <br />
