hereinafter referrcd to as the contractor,
WHEREAS, authuril}~ e~ists in the La~c and Fund, have bcen budge[ed, appropriated and othenvise made
available and a su(ficient unencumbered balance thereof rem~ins available for payment in Fund Number 4008
G/L Account Number 57037 , Contract Eucumbrance Numbe~C153168 ; and
WHEREAS, reyuired approval, clearance and coordination has been accomplished from and with appropriate
agencies:and
tiYHERE:~S, '3 pursuant to Title 37, Article 60, Colorado Revised
Statutes 1973, as amended, the State, through the Colorado Water
Conservation Board, may construct water resource projects and make.
the waters available therefrom to the residents of the State of
Colorado upon conditions to be determined by the Colorado Water
Conservation Board; and
WHER~AS, the Contractor is a duly constituted incorporated city
o£ the State of Colorado and wishes to undertake construction of a
domF~stic water system, hereinafter ca he project, for the Delta
community in Delta County, Color~~stimated cos~ of F'our
Hundred Fifty Thousand Dollars ( and
[di3EREAS, the parties heret t ucted a feasibility
investigation of said project und that such a project is
economically feasible; and
WI3EREAS, the State, through the Colorado Water Conservation Board,
has agreed to construct said project and sell the same to the Con-
tractor upon mutually agreeable terms and conditions, subject to the
approval of appropriations for that purpose by the Colorado General
Assembly and the Governor of the State of Colorado; and
[~HEREAS, pursuant to Senate Bi11 No. 35, Fifty-First General
Assembly of the State of Colorado, duly enacted by the Colorado
General Asembly and approved by the Governor of the State of Colorado,
there was appropriated to the Colorado Water Conservation Board the
sum of Four Hundred Fifty Thousand Dollars ($450,000) for construc-
tion of the Delta Project; and
WHEREAS, the Contractor has available from its own sources and
from a grant to be approved by the Economic Development Administra-
tion (EDA) of the United States Government sufficient funds to
construct the remainder of the project;
tiOW 'PHERLFORE, in consi.deratioil of the mutuai and dep~ndent
covenants herein contained, it is agreed by the parties hereto as
follows:

1. Cause said project to bc constructed witl~in two y~ars of
the date of this contract in accordance with the project plans and
specifications and any necessary modifications thereof i~repared by
it as approved by the State, unless such time is extended by the
