The River District is authorized by its Organic Act to "perform all acts and tlungs necessary or advisable to secure and insure an adequate supply of water, present and future," for beneficial uses within the River District. C.R.S. § 37-46-107(c). 2. The River District owns and conducts a business engaged in water activities pursuant to the Water Ac#ivity Enterprise Act, C.R.S. § 37-45.1-101, et seq., in order to provide beneficial use of water within the District. 3. Summit County is authorized to construct, own, operate and maintain water storage facilities pursuant to C.R.S. § 30-20-402. 4, The Town of Dillon is authorized to construct, own, operate and maintain water storage facilities pursuant to C.R.S. § 31-15-708. 5. The Town of Silverthorne is authorized to construct, own, operate and maintain water storage facilities pursuant to C.R.S. § 31-15-70$. AGREEMENT NOW, THEREFORE, in considerarion of the mutual promises, goals, and policies contained herein, the County, Dillon, and Silverthorne hereby agree as follows: 1, Proiect Mana~ement. The River District shall manage all phases of the Project as described in Recital D above, in consultation with Summit County (as provided for in Intergovemmental Agreement "Exhibit A"), including contracting with outside consultants and/or cantractors to perform analyses, evaluations, engineering, construction, or other necessary activities, for a management fee equal to ten percent (i0%) of all invoices submitted for outsourced work related to the Project.
