The River District is authorized by its Organic Act to "perform all acts and tlungs <br />necessary or advisable to secure and insure an adequate supply of water, present <br />and future," for beneficial uses within the River District. C.R.S. § 37-46-107(c). <br />2. The River District owns and conducts a business engaged in water activities <br />pursuant to the Water Ac#ivity Enterprise Act, C.R.S. § 37-45.1-101, et seq., in <br />order to provide beneficial use of water within the District. <br />3. Summit County is authorized to construct, own, operate and maintain water <br />storage facilities pursuant to C.R.S. § 30-20-402. <br />4, The Town of Dillon is authorized to construct, own, operate and maintain water <br />storage facilities pursuant to C.R.S. § 31-15-708. <br />5. The Town of Silverthorne is authorized to construct, own, operate and maintain <br />water storage facilities pursuant to C.R.S. § 31-15-70$. <br />AGREEMENT <br />NOW, THEREFORE, in considerarion of the mutual promises, goals, and policies <br />contained herein, the County, Dillon, and Silverthorne hereby agree as follows: <br />1, Proiect Mana~ement. The River District shall manage all phases of the Project as <br />described in Recital D above, in consultation with Summit County (as provided for in <br />Intergovemmental Agreement "Exhibit A"), including contracting with outside consultants <br />and/or cantractors to perform analyses, evaluations, engineering, construction, or other necessary <br />activities, for a management fee equal to ten percent (i0%) of all invoices submitted for <br />outsourced work related to the Project.
