This right af participa~ion shall not include any right to <br />fill the Town~s portion ot the expanded Dillon Reservoir with <br />ths portion of the Dillon Ditch water right conveyed to the <br />County. Failure by the Town to accept such offer in writzng <br />within 45 days of receipt of notice thereof shall be deemed <br />to be a rejection by the Town of i~s right to participate in <br />any such enlargement. The Town and County shall be given the <br />opportunity to be a co-applicant in any application to obtain <br />a conditional water right for the expansion of Dillon <br />Reservoir referenced above. <br />6.
