Merrill, Routt County Attorney, and pursuant to Rule 10 of the Recreational In- <br />Channel Diversion rules as adopted by the Colorado Water Conservation Board on November 8, <br />2001, files this Application for Party Status, and as grounds therefor, states the following: <br />Name and Address of Applicant: Board of County Commissioners of <br />Routt County, Colorado <br />P.O. Box 773598 <br />Steamboat Springs, CO 80477 <br />2. Brief Statement of Reasons Why the Applicant is Seeking Party Status: <br />Routt County (the "County") operates the public water system for the Phippsburg <br />community pursuant to C.R.S. § 30-20-402. The Phippsburg community is an <br />unincorporated community in the southern portion of Routt County, upstream of the City <br />of Steamboat Springs. The County is the owner of at least one decreed water right from <br />sources in the Yampa River and its tributaries which water right is used to provide water <br />for the Phippsburg community. The point of diversion for this water right is upstream of <br />the City of Steamboat Springs and upstream of the point of diversion for the Recreational <br />In-Channel Diversion that is the subject of the filing by the City of Steamboat Springs <br />(the "City RICD"). County is the governmental entity having primary responsibility for <br />land use planning and other functions within the unincorporated portions of Routt County <br />through which the Yampa River and some of its tributaries flow.
