t <br />Colorado Water Conservation Board <br />Concerning the Application for Water Rights of the City of <br />Steamboat Springs <br />in the Yampa River <br />in Routt County <br /> Case Number: <br /> 6-03CW86 <br />NOTICE OF PREHEARING CONFERENCE AND DEADLINES <br />Pursuant to Rule 12 of the Rules Concerning Recreational In-Channel Diversions <br />("RICD Rules"), several entities seeking party status requested a hearing on the RICD <br />application of the City of Steamboat Springs ("Steamboat"). [See, e.g., "Request for <br />Public Hearing" of Board of County Commissioners of Routt County, dated February 17, <br />2004.] At its regular meeting on March 16, 2004, the Colorado Water Conservation <br />Board ("Board") designated Felicity Hannay as the Hearing Coordinator for this <br />proceeding, and determined that the Board will hold the hearing in Steamboat Springs, <br />Colorado beginning at 8:00 a.m. on May 26, 2004, and continuing as necessary on May <br />27, 2004. The specific location in Steamboat Springs will be determined and notice <br />thereof posted on the Board's website in the near future. <br />Pursuant to RICD Rule 13, the Hearing Coordinator hereby establishes the <br />following deadlines for written submissions and designation of witnesses and exhibits, <br />and the date of the prehearing conference. Fifteen copies of each document must be <br />submitted to the Board, and a copy of each document must be provided to the Board's <br />staff, the Hearing Coordinator, the Assistant Attorney General representing Staff, and the <br />Parties. Please note that due to the compressed time frame, the Board, the Board's <br />Staff, and the Parties must receive documents by no later than 4:45 p.m. on the day <br />that they are due. <br />Apri114, 2004: Applicant's prehearing statement is due. Pursuant to RICD Rule 13.d, <br />the prehearing statement shall include: (1) a list of all factual and legal issues the <br />Applicant intends to raise at the hearing; (2) a list identifying all of the witnesses that will <br />testify for the Applicant, and a summary of the testimony that those witnesses will <br />provide; and (3) copies of exhibits that the Applicant will introduce at the hearing. <br />Apri128, 2004: Prehearing statements of all other Parties, including Staff, are due. <br />Pursuant to RICD Rule 13.d, the prehearing statements shall include: (1) a list of all <br />factual and legal issues disputed by the Party, and the Party's position regarding those <br />issues; (2) a list identifying all of the witnesses that will testify for the Party, and a <br />summary of the testimony that those witnesses will provide; and (3) copies of all exhibits <br />that the Party will introduce at the hearing. Staff's prehearing statement may also include <br />a recommendation for action by the Board. <br />L-4
