The claimed flow rates are "the minimum stream flow ... for a reasonable <br />recreational experience in and on the water." <br />CWCB Staff argues that the City has failed to support its claimed flow rates, and that the <br />claimed flows are inconsistent with the "minimum amounts" listed in the table of "minimum" and <br />"optimal" flows rates for different activities that was generated by the City Staff for the City <br />Council in October, 2003. (Exh. S-9, hereafter "Table 2".) Staff also argues that the claimed <br />flows are too high when measured against the 350 cfs cap in the Board's November 21, 2003, <br />Technical Criteria Manual. That 350 cfs cap number is purportedly based on "objective" criteria <br />from a 2001 river study by Bo Shelby concerning boating on Clear Creek in Golden, and also on <br />Mr. McLaughlin's experience designing other boating courses. <br />In response, the City asserts that (a) the claimed amounts are reasonable to serve its <br />intended purpose; (b) the highest claimed flow rate of 1700 cfs is only for two weeks a year and is <br />Ph0751;2 -11-
