Diversron ("RICll") Ruies adopted <br />by the Colorado Water Conservation Soard ("CWCB") on November 8, 2001 (the <br />"RICD Rules") and the Notice of Prellearing Conference a.nd Deadlines dated March 31, <br />2004 estabiished by the Hearing Coordinator, Fclicity Huuzay, the Upper Yampa Water <br />Conservancy District ("District") submits its rebuttal statement as follows: <br />YNCORPORAT[ON OF OTHER PARTY REBUTTAL STATEMENTS <br />The District incorporates herein by this reference the Rebuttal Statements of Routt <br />County, Colorado ("Routt County"), che Morrison CreeIc Metropolitan Water and <br />Sanitation Distriet ("MCMWSD"), the Town of Oa.k Creek ("Oalc Creelc"), and <br />the Tovvn af Yampa ("Yampa"). The efforts of Rvutt County and tlZese olher <br />opposers in connection with the May 26-27 2004 hearing (the "Hearing") bcfore <br />the CWCB are being eoordinated to avoid duplicative presentations. <br />1 The adjudication and administration of rhe RICD will impair Compact <br />l+ntildenze»ts ancl mtaximttm utilizctrioyt cannot occur. <br />The CWCB Prehearing Statement fuds that tlie proposed RICD will not impair <br />the ability of Colorado to fully develop and place to consumptive use its compact <br />eniitlements. fiowever, the Board also finds lliat maximum Litilization is nol <br />aehieved. The Districc believes that the two issues go hand in h1nd. <br />Development of compact entitlements depends on the District's abiliry to utilize co <br />the mitximuin extent tlie available water resources in the Upper Yampa basin to <br />accoirrnodate the future growth of its constitueney.
