The CWCB Prehearing Staiement finds access to Ue appropriale for purposes of <br />the 12TCD. One of the ciiteria it considers when determining the issue of <br />appropriate access is wliether thc Applicant has on ownersliip, leasEhold, or other <br />Iega1 interesti for obtaining access for recreational, in-channel use. See, RICD <br />ltules, No. 7.(ii). Additionally, the CWCB must evaluate whetlaer the Applicant <br />has or will have aiiy ixnpediments to gaining access, if laclc of access is <br />demonstrated. Id., at 7,(iii). Morrison Creek's Prehearing Statement ciemonstrates <br />that ownership, a leasehold interest, or any other legal interest is not lield by the <br />City for a ponion of the properry on which C Hale (or "Structure") sits. That <br />property is owned by the Union Pacific Railroad as evideneed by thE lease <br />provided in Morrison Creelc's Prehearing Statement. See, Monisoii Creelc <br />PrehEaring Statement, Exhibit 1. Fu.rther, the City lias provided no evideilce that <br />they are in t1ie process of acquiring ownership rights in the Property and the <br />Siructure. <br />-1-
