Witnesses <br />The District may introduce the following rebuttal witnesses: <br />1. Chan Spears, a longtime resident of Steamboat Springs, and one of the original <br />members of the Friends of the Yampa, may testify as to his recreational <br />enjoyment in the play holes ("Structure Nos. 1 and 2") at various levels. <br />Specifically, he will provide his observations that a water level of more than 350 <br />cfs at the Structures actually deters him from utilizing the play holes since the <br />play waves become too difficult and strenuous to offer an enjoyable recreational <br />experience. He may also offer observations he has made with respect to the <br />enjoyment of other kayakers, at varying abilities and ages, through the Structures. <br />Mr. Spears may also testify to his observations regarding the impact of the <br />Structures on the erosion of the river embankment and detrimental impact to the <br />surrounding fish habitat. <br />2. Jason Yanowitz, an associate with Weiss and Van Scoyk, LLP, may offer <br />testimony regarding his research regarding the activity of Tubing, and the <br />significance of the Structures to this experience. <br />EXH1B[TS <br />The District may introduce the following rebuttal exhibits: <br />1. Updated Yampa River Observations. <br />2. Letter Report prepared by John Redmond of Montgomery Watson, analyzing <br />potential small reservoir sites in the Upper Yampa Basin. <br />3. E-mail communication from Tom Whiddon, Community Service Supervisor, <br />Steamboat Springs Police, regarding rescues of tubers from "C" Hole. <br />4. Letter from Jason Yanowitz to John Fetcher regarding research regarding the <br />significance of tubing as a sport and the contribution of the Structures to this <br />activity. <br />5. Letter report prepared by Drs. Chester C. Watson, Ph.D., P.E. and Christopher I. <br />Thornton, Ph.D., P.E., regarding the Structures impacts on the flood plain. <br />6.
