<br />~ <br /> <br />(a) For the purposes of supplying <br />water for irrigation, municipal, domes- <br />tic, and industrial uses, generating and <br />transmitting hydroelectric power and <br />energy, and controlling floods, and for <br />other useful _and beneficial purposes <br />incidental thereto, including recreation <br />and the conservation and development of <br />fish and wildlife, the Secretary of the <br />Interior is authorized to construct, <br />operate, and maintain the <br />Fryingpan-Arkansas proj ect. . . . '- - <br />This language is substantially identical to that used <br />to authoriie the Starepede Dam in the Carson-Truckee <br />case. <br /> <br />.-- <br /> <br />Consequently, an argument exists that the Bureau of <br />Reclamation's obligation for operation of Ruedi net <br />only would be to avoid jeopardy but also to operate <br />the dam in such a manner as to maxiDize the likeli- <br />hood of recovery of the endangered fish species to a <br />non-endangered status. There still appears, however, <br />to be a strong predilection within BOR to market the <br />water in Ruedi rather than meet any minimum stream <br />flow demands. <br /> <br />-41- <br />
