(a) For the purposes of supplying
water for irrigation, municipal, domes-
tic, and industrial uses, generating and
transmitting hydroelectric power and
energy, and controlling floods, and for
other useful _and beneficial purposes
incidental thereto, including recreation
and the conservation and development of
fish and wildlife, the Secretary of the
Interior is authorized to construct,
operate, and maintain the
Fryingpan-Arkansas proj ect. . . . '- -
This language is substantially identical to that used
to authoriie the Starepede Dam in the Carson-Truckee
case.

Consequently, an argument exists that the Bureau of
Reclamation's obligation for operation of Ruedi net
only would be to avoid jeopardy but also to operate
the dam in such a manner as to maxiDize the likeli-
hood of recovery of the endangered fish species to a
non-endangered status. There still appears, however,
to be a strong predilection within BOR to market the
water in Ruedi rather than meet any minimum stream
flow demands.
