<br />**111. <br /> <br />D <br /> <br />vlILL FWS RE-EXAMINE THE STATUS OF THE FISH TO DETERHINE <br />WHETHER THEY ARE CURRENTLY PROPERLY LISTED AS <br /> <br />"ENDANGERED ." <br /> <br />FWS has informally advised that it has no intention of <br /> <br />reassessing the status of the fish to determine whether <br />they are properly listed as "endangered." On the other <br />hand, anyone may petition to have a species delistecl under <br />the ESA. Such a filing must contain substantial data with <br />emphasis on past population history, current population, <br />and description of key habitat criteria. , Within ninety <br />days, FWS must make a determination whether data presented <br />indicates that the petitioned action "may be warranted." <br />If so, the FWS has one year from the date of filing to <br />make a determination to delist. __ <br /> <br />No outside actions have occurred to date involving fish <br />which have been successful in achieving "delisting." <br /> <br />The Colorado River squawfish was listed after the passage <br />of the Endangered Specic& Preservation Act of 1964 without <br />the type of formal review now required. The squawfish was <br />grandfathered into the current list when the Endangered <br />Species Act of 1973 was passed. To our knowledge the <br />basis for listing has not been reviewed. <br /> <br />, .~ l <br /> <br />.
