<br />**11. <br /> <br />1> <br /> <br />THE RECOVERY FACILITIES SUGGESTED AS PART OF THE <br />PRESENT SETTLEMENT CONSULTATIONS BASED ON "WINDY <br />GAP"-PLUS REPRESENT, BEYOND ACTUAL CONSTRUCTION, <br />MAJOR ACCESS, LAND PROBLEMS. IS TITS WILLING TO <br />PARTICIPATE IN ASSl~ING O&M RESPONSIBILITIES AND <br />RELATED LIABILITIES? <br /> <br />At a recent meeting with F1JS to discufls the Draft <br />Biological Opinion for NAEI's Par~chute Shale Oil <br />Project, i.t ~as evident that FlJS had not considered: <br /> <br />a. the need for any additional land or access; <br />b. the design or costs of the screen; <br />c. the ongoing responsibility and cost for opera- <br />tion and tr.aintenance (O&M) of a screen once <br />installed; <br />d. the residual liability to MAEI if the intake <br />structure fails to accomplish th~ desired goal; <br />e. the liability if the intake structure impairs <br />the irrigation company's (o~mer of existing dam) <br />ability to supply water; or <br />f. the responsibility for obtaining permits to <br />construct the proposed screen. <br /> <br />The FWS has not even consulted the owner of the <br />irrigation intake to discuss acceptability of the <br />proposal. <br /> <br />-28- <br />
