Gimbel <br />Watershed Protection & Flood Mitigation Section <br />CWCB Director <br />Dan McAuliffe <br />DATE: July 9 , 2009 <br />CWCB Deputy Director <br />Agenda Item 16 , July 21 - 2 2 , 2009 Board Meeting <br />SUBJECT : <br />CWCB Floodplain Rules and Regulations – Status Update <br />Introduction and Background <br />The CWCB originally promulgated floodplain rules and regulations (Rules) in 1988, and then <br />undertook a formal rulemaking process to revise th em in 2005 . An in - depth informational <br />presentation was provided to the Board at its May 2009 meeting in Pueblo to discuss staff’s <br />desire to move forward with revisions to the current Rules. <br />T he purpose of the Rules is to provide uniform standards for regulatory floo dplains in Colorado, <br />including standards for activities that may impact those floodplains , and to stipulate the process <br />by which floodplains will be desig nated and approved by the CWCB. <br />Staff presented conceptual rule changes to the Board at its May 2009 meeting in Pueblo, and <br />received excellent feedback at that time. This current agenda item will involve a relatively brief <br />update for the Board regarding the on - going rulemaking proposal and related topics. <br />As a reminder, s taff is conducting the rule making effort with assistance from an Advisory <br />Committee and the Attorney General’s Office, which will provide technical input and legal <br />guidance for proposed changes to the Rules. <br />Staff Recommendation <br />This is an informational item only and s taff is not requesting Board action at this time. <br />Water Supply Protection • Flood Protection • Stream & Lake Protection • Wat er Supply Planning & Finance <br />Water Conservation & Drought Planning • Intrastate Water Management & Development <br />
