(III) (C) Studies or analyses of structural, nonstructural, <br />consumptive, and nonconsumptive water needs, projects, or activities; and <br />(IV) (D) Structural and nonstructural water projects or activities. <br />(II) O O 31 , <br />N OR BEFORE CTOBER OF EACH YEAR COMMENCING WITH <br />2010, <br />THE YEAR THE BOARD SHALL CONSULT WITH THE INTERBASIN <br />COMPACT COMMITTEE TO PRODUCE THE ANNUAL REPORT REQUIRED BY <br />37-75-105 (4), C.R.S., <br />SECTION REGARDING HOW MONEYS IN THE ACCOUNT <br />- . <br />WERE ALLOCATED IN THE PREVIOUS TWELVE MONTH PERIOD <br />SECTION 2. <br /> 39-29-109.3 (2) (a), Colorado Revised Statutes, is <br />amended to read: <br />39-29-109.3. Operational account of the severance tax trust fund <br />- repeal. <br /> (2) Subject to the requirements of subsections (3) and (4) of this <br />section, if the general assembly chooses not to spend up to one hundred <br />percent of the moneys in the operational account as specified in subsection <br />(1) of this section, the state treasurer shall transfer the following: <br />(a) (I) To th e water supply reserve account created in section <br />39-29-109 (2) (c), the following amounts: <br />(A) For the state fiscal year commencing July 1, 2008, ten million <br />dollars. This sub-subparagraph (A) is repealed, effective July 1, 2010. <br />(B) For the state fiscal year commencing July 1, 2009, ten million <br />dollars. This sub-subparagraph (B) is repealed, effective July 1, 2011. <br />(C) For the state fiscal year commencing July 1, 2010, six <br />TEN <br />million dollars. This sub-subparagraph (C) is repealed, effective July 1, <br />2012. <br />(D) F J 1, 2011, <br />OR THE STATE FISCAL YEAR COMMENCING ULY AND <br />, . <br />FOR EACH STATE FISCAL YEAR THEREAFTER TEN MILLION DOLLARS <br />(II) (A) On June 30, 2011, any unencumbered and unexpended <br />balance in the water supply reserve account created in section 39-29-109 (2) <br />(c) shall revert to the operational account created in section 39-29-109 (2) <br />(b). <br />PAGE 3-SENATE BILL 09-106 <br /> <br />
