No. 17766* <br />1525 Sherman Street, 5th Floor <br />Denver, CO 80203 <br />Telephone: (303) 866-5046 & (303) 866-5072 <br />*Counsel of Record <br />TRIAL BRIEF <br />Objectors, the Colorado Water Conservation Board (the "CWCB" or "the Board") <br />and the State and Division Engineers (the "State Engineers"), (collectively, "the State") <br />through their undersigned counsel, hereby submit this Trial Brief. <br />INTRODUCTION <br />This case involves an application by the Upper Gunnison Water Conservancy <br />District ("Applicant") for a recreational in-channel diversion ("RICD") water right <br />authorized under Senate Bi1101-216 ("SB 216"). Under SB 216, an Applicant may apply <br />for the "minimum stream flow" for "a reasonable recreation experience...." § 37-92- <br />103(10.3), C.R.S. (2002). An Applicant for an RICD must submit its application to the <br />CWCB for review. § 37-92-102(5), C.R.S. (2002). The CWCB must thereafter make <br />fmdings of fact and a fmal recommendation as to whether the application should be <br />" _ I K <br />0 I-iG?S
