I. STATEMENT OF ISSUES <br />Amici Northwest Colorado Council of Governments et al. adopt the Statement of Issues <br />stated by Appellee Upper Gunnison River Water Conservancy District ("Upper Gunnison <br />District"). <br />II. STATEMENT OF CASE <br />Amici Northwest Colorado Council of Governments et al. adopt the Statement of Case <br />stated by Appellee Upper Gunnison District. <br />III. SUMMARY OF ARGUMENT <br />Recreation is a cornerstone of the Sta.te's economy and significant funds have been <br />appropriated to market Colorado's tourist and recreational opportunities. Specific to Amici <br />Northwest Colorado Council of Govemments et al, recreation and tourism represent the lazgest <br />industry on the west slope. Revenues generated both directly and indirectly aze critical to the <br />local governments and special districts represented by Amici Northwest Colorado Council of <br />Governments et al, and to the long-term health of Colorado's economy. <br />Loca1 governments aze charged with decision-making to effect economic and community <br />development. Activities in and on the water are key elements in the competition for tourist <br />dollars associated with the recreation industry, and in-channel diversions are a key element to <br />development of opportunities for water-based recreation. Where governments build expensive <br />facilities to create a water-reliant recreational opportunity, those water rights applications filed to <br />protect that investment should be entitled to fair and equal treatment along with more traditional <br />water rights applications. Senate Bi11216 ("S.B. 216") carefully delineates the role of the <br />Colorado Water Conservation Boazd ("CWCB") in the recreational in-channel diversion
