Summary of Argument <br />Both the District and the State agree that Senate Bill 216 ("SB 216") was enacted to address <br />the fear that recreational in-channel water rights could be misused to allow an appropriator to <br />command the entire flow of a stream or river, thereby preventing upstream development and affecting <br />Colorado's abilityto fully develop its interstate compact entitlements. However, the parties disagree <br />about the way in which SB 216 addressed this fear. In particular, the District disputes the State's <br />, <br />, ?d ^ ^ Ct-?d? <br />.--- <br />Z
