13. The matter proceeded foilowing application in the Water Court to a <br />submittal to the Colorado Water Conservation Board as contemplated <br />under the recent legislation addressing applications for recreational in <br />channel diversion ("RICD"), typically referred to as Senate Bill 216 which <br />became effective in 2001. This legislation was effective June 5, 2001. <br />The application was submitted to the Colorado Water Conservation Board <br />on April 10, 2002. <br />14. Consistent with Senate Bill 216, the Colorado Water Conservation Board <br />adopted rules concerning "RICD" as of November 8, 2001, State exhibit <br />10. <br />15. The stafF pre-hearing recommendation to the CWCB is State's exhibit 6. <br />16. The hearing before the CWCB occurred September 10, 2002 and a <br />transcript of that is State's exhibit 8. <br />17. At the conclusion of the hearing the Board made various findings. Those <br />findings were reduced to writing dated October 11, 2002. In relevant part, <br />the findings are as follows: <br />(a) That 250 cfs of water from May through September be allowed and <br />with that flow and the conditions in the recommendations set forth <br />in the findings found <br />(i) The RICD will not impair Colorado's ability to fully develop <br />and put to beneficial use its compact entitlements. <br />6
