This matter involves the application brought by Upper Gunnison for a <br />recreational in-channel diversion ("RICD"), the first case to be tried under Senate Bi11216, <br />C.R.S. §§ 37-92-101 et seq. As provided in C.R.S. § 37-92-102(6), a hearing was held before the <br />Colorado Water Conservation Board ("CWCB") on September 10, 2002. The Board of Directors <br />deliberated both at that hearing and by telephone conference on October 1, 2002. CWCB issued <br />its written Findings and Recommendations on October 11, 2002.
