Appellants, the Colorado Water Conservation Board ("CWCB") and the State <br />Engineer, Division Engineer for Water Division 4(collectivf,ly "the State"), through <br />the Attorney General for the State of Colorado and the undel-signed Assistant <br />Attorney General, hereby request an extension of time in which to file their opening <br />brief, and in support therefor, state the following: <br />1. The Notice of Appeal in this matter was timely filed on February 9, 2004. <br />Under the time computation guidelines set forth under Rule 26, C.A.R., the <br />Opening Brief is due on Monday, June 21, 2004. <br />2. This case is one of first impression and involves the first application of <br />Senate Bill 01-216 to an application for a recreational in-channel diversion <br />("RICD") water right. In light of the importance of the issues raised, it is <br />in the best interests of this Court to allow counsel adequate time to prepare <br />the Opening Brief. <br />3. Counsel and CWCB Staff were busy preparing during the months of April <br />and May for the CWCB hearings in Case 03CW86 and Case 0 1CW275, <br />the applications of the City of Steamboat and the City of Longmont, <br />respectively, for RICD water rights. <br />4. Further, Counsel was also busy preparing for a trial on an issue of first <br />impression that is scheduled to commence August 24, 2004. Pretrial <br />motions in that case will be due June 22, 2004.
