PREHEARING STATEMENT OF COLORADO RIVER WATER CONSERVATION DISTRICT <br />Conceming the Application for a Recreational In-Channel Diversion for the Town of Silverthorne, Colorado <br />Page 3 <br />III. CONCLUSION <br />The River District believes the adjudication and administration of the Silverthorne RICD <br />will not interfere with maximum utilization of the waters of the State if protective terms and <br />conditions are required to ensure that the adjudication and administration of the Silverthorne <br />RICD: <br />A. Does not interfere with the ability of the Old Dillon Enlargement participants to <br />obtain a change decree or exchange decree that allows maximum use of the water <br />rights. <br />B. Is not used as the basis for objection to the Everist Pumpback. <br />C. Does not cause curtailment of the use and reuse of the Upper Blue Water and any <br />related exchanges. <br />IV. EXHIBITS <br />A. Intergovernmental Agreement between Summit County and the River District to <br />develop alternatives for Old Dillon Reservoir Enlargement (2004). <br />B. Executive Summary of the UPCO Study by Hydrosphere (May 23, 2003). <br />C. Summit UPCO Water Supply Study by Boyle Engineering (December 15, 2004). <br />D. Colorado Springs Substitution Memorandum of Agreement (May 15, 2003). <br />E. Colorado Springs Substitution Water Rights Application (Case No. WDS <br />03CW320) <br />V. WRITTEN TESTIMONY <br />The written testimony of David Merritt, Chief Engineer of the River District is attached. <br />VI. WITNESSES <br />A. Eric Kuhn, Colorado River Water Conservation District, 201 Centennial Street, <br />Suite 200, P.O. Box 1120, Glenwood Springs, Colorado 81602; (970) 945-8522. <br />Mr. Kuhn is the General Manager of the River District and may testify during the <br />hearing on technical matters related to the Silverthorne RICD. <br />B. David Merritt, Colorado River Water Conservation District, 201 Centennial <br />Street, Suite 200, P.O. Box 1120, Glenwood Springs, Colorado 81602; (970) 945- <br />8522. Mr. Merritt is the Chief Engineer at the River District and may testify <br />during the hearing on technical matters related to the Silverthorne RICD.
