Denver stipulates that the granting of the Application as modified herein, <br />and subject to the terms and conditians of its proposed Findings of Fact, <br />Conclusions of Law, Judgment and Decree attached hereto as Appendix 1. <br />2. Denver agrees to execute a stipulated Motion for Summary Judgment providing <br />for entry of a Decree i n the r"orm of the proposed Decree attached hereto as <br />Appendix 1 and consents to the entry of any modified form of Decree ultimately <br />entered by the Court so long as its terms and conditions are not less restricti.ve <br />than those contained in Appendix 1. <br />3. Entry of a decree in this matter does not author?ze the Applicant to <br />construct facilities on Denver's property or rights-of-way without Denver's <br />granting of a license. <br />4.
