Case No. 86CW330 <br />Page 4 <br />Applicant will calculate the irrigation deep percolation amount by <br />multiplying the amount of water delivered for irrigation that month by <br />0.15. There are delays between the delivery of water for irrigation and <br />return to the Blue River drainage of 15% of that water. The irrigation <br />return flows considered to accrue to the Blue River shall be calculated by <br />applying the following monthly factors to the deep percolation amounts <br />occurring in each month of the irrigation season: <br />Month in Which Lagged Return Flows Occur <br />Starting With Month of Application Factor <br />Month 1 0.6 <br />Month 2 0.2 <br />Month 3 0.1 <br />Month 4 0.1 <br />These factors shall be multiplied by the deep percolation amount occurring in any <br />given month to determine return flows in the month during which the Application <br />occurred (month 1) and in months following the time of Application (months 2 <br />through 4). Return flows in any given month shall be equal to the sum of return <br />flows occurring from deep percolation during the month plus return flows <br />occurring due to previous months deep percolation. As an example, a sample <br />calculation showing how return flow credits shall be calculated is shown in <br />Exhibit A. <br />12. Determination of Net Out-of-Priority Depletions: Net depletions shall be <br />calculated on a daily basis by taking out-of-priority diversions made at the <br />Dillon Blue River Intake and subtracting associated in-house use return flows <br />from the Joint Authority Wastewater Treatment Plant and also subtracting outside <br />use return flows as determined in ¶11 above. Unconsumed portions of Applicant's <br />diversions at the Blue River Intake ,.return to the Blue River from the Joint <br />Authority Wastewater Treatment Plant and as irrigation return flows. Flows from <br />the Joint Authority Wastewater Treatment Plant accrue to the Blue River in the <br />NE4 of the NE4 of §35, T4S, R78W of the 6th P.M., Summit County, Colorado. <br />Irrigation return flows accrue to the Blue River at or above the confluence of <br />Straight Creek and the Blue River in the SE', of §12, T5S, R78W of the 6th P.M., <br />Summit County, Colorado. Depletions attributable to diversions under this decree <br />will be determined by dividing the diversions under this decree by the total <br />diversions made by the Applicant from all of its appropriations and multiplying <br />the resulting quotient by the total depletions calculated pursuant to this <br />paragraph. Net depletions then will be replaced by releases made from Old Dillon <br />Reservoir to the Blue River as described in 18. <br />13. Stipulations. <br />a. Applicant and the Colorado Water Conservation Board entered into a <br />stipulation dated October 25, 1988, regarding their respective water court <br />cases. Specifically, applicant has agreed to abide by the following <br />relevant terms and conditions in the operation of this augmentation plan <br />and exchange. . <br />i.
