DISTRICT COURT, WATER DIVISION NQ. 5, STATE OF COLORADO <br />Case No. 86CW330 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, JUDGMENT AND DECREE <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE TOWN OF DILLON IN SUMMIT <br />COUNTY <br />This matter, having come before this Court on stipulated facts agreed to by all <br />parties to this case, and the Court having considered the files herein and the <br />? Motion for Summary Judgment executed by all parties, hereby enters the following <br />Findings of Fact, Conclusions of Law, Judgment and Decree: <br />FINDINGS OF FACT <br />1. Applicant: The Applicant's name, address and phone number are: <br />Town of Dillon <br />P. 0. Box 8 <br />( Dillon, Colorado 80435 <br />1 (303) 629-6342 <br />2. Application and Statements of Opposition: The Application herein was filed <br />on December 26, 1986. A first amendment to the Application was filed on <br />January 31, 1989 and accepted by the Court on March 1, 1989. A second amendment <br />to the Application was filed on May 30, 1990 and accepted by the Court on <br />June 21, 1990. The Application herein was published in accordance with law and <br />due and proper notice has been given. None of the lands involved herein is <br />located within a designated groundwater basin. Timely statements of opposition <br />to the Application were filed on behalf of the following parties: 1) The City <br />and County of Denver ("Denver"); 2) The City of Colorado Springs; 3) The Town of <br />Silverthorne; 4) The Dillon Valley District; and 5) The Breckenridge Ski Area. <br />An Order allowing the withdrawal of the Statement of Opposition filed by the <br />Breckenridge Ski Area was entered March 2, 1987. An Order allowing the <br />withdrawal cf the Statement of Oppositicn filed by the Dillon Yalley District was <br />entered on March 6, 1989 and an Order reinstating that Statement of Opposition <br />was entered August 27, 1990. No other statements of opposition were filed and <br />the time for doing so has expired. <br />3. Jurisdiction: The Court has jurisdiction over the parties, over the <br />subject matter of this Application, and over water users who may be affected, <br />whether they have appeared or not. <br />4. Description of Applicant: The Town of Dillon (the "Applicant") is a town <br />created and operated pursuant to Colorado law. The Town provides inter alia, <br />water and sewer service to its residents. <br />5. Requests for Relief: The Applicant requests: 1) an approval of a plan for <br />augmentation; and 2) a determination of a conditional water right for an <br />appropriative exchange. <br />?
