Releases from Green Mountain Reservoir and Lake Granby <br />are made directly to the Blue River and Colorado River respectively at the <br />locations described in 17 above. Applicant shali make the releases ar cause <br />releases to be made at times requested by the Division Engineer or appropriate <br />Water Commissioner. Applicant shall not be required to make replacement under <br />this subparagraph if there are no senior unsatisfied rights below Denver's Dillon <br />Reservoir. Diversions under the plan for augmentation decreed herein shall be <br />limited to 350 acre feet annually unless this decree is amended. <br />9. Compliance with the Sumnit County/Denver Agreement: To the extent that 0.58 <br />acre feet of replacement water shall be furnished to Denver for each acre foot <br />diverted out of priority by the Applicant, Denver will not utilize its water <br />rights to prevent the operation of the subject augmentation or exchange plan <br />pursuant to the terms of the Summit County/Denver Agreement dated September 18, <br />1985. The water to be furnished to Denver by the Applicant may include water <br />from Old Dillon Reservoir, Green Mountain Reservoir, Granby Reservoir or other <br />sources permitted by the Summit County/Denver Agreement, provided that if water <br />is supplied from Old Di71on Reservoir, the water is re7eased at times requested <br />by Denver. Should Applicant not furnish Denver with the requisite amount of <br />replacement water pursuant to the Summit County/Denver Agreement, the Applicant's <br />diversions hereunder shall be reduced accordingly. <br />10. Appropriation of Exchanges: Applicant seeks confirmation of its <br />appropriation of the following conditional exchanges: <br />a. From Granby Reservoir and Green Mountain Reservoir, as described in <br />17.b. and 17.c. above to those points of diversion described in 16 above. The <br />conditional exchange from Green Mountain Reservoir to the points of diversion <br />described in 16 does not replace, waive or otherwise affect any exchange decreed <br />for the benefit of the Applicant in the Blue River decrees, Case Nos. 2782, 5016, <br />and 5017 in the United States District Court for the District of Colorado or in <br />Case No. 87CW382, District Court for Water Division No. 5, State of Colorado. <br />The exchanges described above from Lake Granby and Green Mountain Reservoir are <br />claimed with an appropriation date of May 6, 1986. <br />b. From Old Dillon Reservoir, as described in 17.a. above to the Town of <br />Dillon Straight Creek diversion and the Town of Dillon Laskey Gulch diversion <br />described in q6.i and Q6.j above. Water from Old Dillon Reservoir will be <br />released to the Blue River at or above the confluence of the Blue River and Salt <br />Lick Gulch at the point described in 18 above, and exchanged to points of <br />diversion named above. The Applicant claims an appropriation date of September <br />29, 1987 for these exchanges. An exchange from Old Dillon Reservoir to the <br />Dillon Blue River Intake has been decreed by this Court in Case No. 86CW330 and <br />is not affected by entry of this decree. <br />c. The exchanges descri bed above may be operated at rates up to 5 cfs <br />provided that there is sufficient flow in the streams to permit the exchange. <br />11. Accounting and Measurement: Applicant shall conduct the following account- <br />ing during any month this plan for augmentation and exchange is operated. Copies <br />of Applicant's ongoing accounting for this augmentation plan will be provided <br />monthly to the Division Engineer and to any other party upon request. The <br />Applicant shall develop accounting forms acceptable to the Division Engineer.
