COLORADO DEPARTMENT OF NATURAL RESOURCES <br />COLORADO WATER CONSERVATION BOARD <br />PRE-HEARING STATEMENT OF THE TOWN OF DILLON <br />Concerning the Application for Water Rights for a Recreational In-Channel <br />Diversion of the Town of Silverthorne in Summit County <br />The Town of Dillon ("Dillon"), by its attorneys, hereby submits its Pre-hearing Statement in <br />this matter. <br />INTRODUCTION <br />The primary concern for Dillon is the potential interference of the RICD with Dillon's current <br />and future changes and exchanges of water rights from Old Dillon Reservoir and Old Dillon <br />Reservoir First Enlargement on the Blue River near the upstream end of the proposed RICD <br />reach. The Town of Dillon is located on the east side of Denver's Dillon Reservoir. Dillon <br />owns water rights decreed for municipal and augmentation purposes, among other uses, on <br />the Blue River, Straight Creek and Salt Lick Gulch. The current source of water for Dillon is <br />Straight Creek, which enters the Blue River immediately upstream of the proposed RICD. <br />Dillon also has decreed rights to divert water from the Blue River through surFace diversions <br />above Denver's Dillon Reservoir, wells located on Straight Creek, and wells on the Blue River <br />near the proposed RICD (Silverthorne Well Nos. 1 and 2). <br />Dillon owns Old Dillon Reservoir, which is filled by diversions from Salt Lick Gulch. Old Dillon <br />Reservoir is located on the west side of Denver's Dillon Reservoir, and as a result, cannot <br />presently be used directly by Dillon in its municipal water system. Water from Old Dillon <br />Reservoir can be released back into Salt Lick Gulch for delivery to the Blue River <br />immediately below the Interstate-70 overpass and Wildernest Road. The confluence of Salt <br />Lick Gulch with the Blue River is near the upstream end of the proposed RICD. Old Dillon <br />Reservoir is one of the decreed sources for augmentation of Dillon's water rights in Case <br />Nos. 87CW392 and 86CW330. Dillon may require other changes of water rights or <br />exchanges to fully utilize Old Dillon Reservoir. <br />Dillon also owns a 20% interest in the Old Dillon Reservoir First Enlargement conditional <br />water right decreed in the amount of 150 acre feet in Case No. 93CW288 ("Enlargement"). <br />Dillon has a decreed exchange of 20 acre feet from Clinton Gulch Reservoir up Salt Lick <br />Gulch to the Old Dillon Reservoir First Enlargement in Case No. 95CW077. Dillon may <br />require further changes of the Enlargement or exchanges to fully utilize that water right. <br />\
