cwoaai7 <br />Contracted Water includes the right to reuse and successively use the retum <br />flows, provided that na judicial, regulatory or other administrative order is entered <br />finding that the River District or Contractor does not have the legal right to reuse <br />and successively use the return flows. <br />"Project Yeaz" means a period of time from July 1 of one yeax through and <br />including 3une 30 of the subseqnent yeaz. <br />"Water Markehng Policy" means the Rivez District's-policy statement as revised <br />and readopted July 21, 2004, and as the same may be amended in the future. <br />"Project Hydrology Assumptions" or "Hydrology Assumptions" means #he <br />document attached as Appendix "A" to the QVater Marketing Policy adopted on <br />. <br />December 1, 1995. <br />AGREEMENTS <br />The foregoing Recitats and Definitions are incorporated herein as agreements between <br />the River District and Contra.ctor. <br />l. River District VJater Deliverv Obligations an.d Resnonsibilities. <br />a. Delive . The River District will delivez the Contracted Water at the outlet works <br />of the Contracted Water's sources af sapply into the receiving natural streams in <br />quantities provided herein at any time between June 15 and Noveznber 15 and at <br />other times as provided in the MOA. Unless atherwise agreed to by the River <br />District's General Manager based upan written request o£ Contractor, the River <br />District will m.ake releases for Contractor, based upon Contractor's written <br />schedule of anticipated demand, adjusted as necessary by the ongoing status of <br />river adrninistration vis-a-vis the priority statvs of Contractor's cliversions. <br />Contractor shall be solely responsible after delivery for the legal and physical <br />delivery and use of the Contracted Water. . <br />h. Deliverv Contingencies. The River District's delivery of Contracted Water shall <br />be subject to Cantractor's commitrnent of its Middle Park water pursuant to <br />para.graph 3 below; the provisians for curtailment of deliveries in paragraph 5 <br />below; and fihe terms and conditions of the MOA. <br />c. Watex Measurements. The River District shaIl notify the Division Engineer of <br />Colorado Water Division No. S of the date, tiane and amount of Contracted Water <br />released and delivered pursuant to this Contract. Copies of such records shall be <br />provided to Contractor upon its request therefor.
