2003 WATER DELlVERY MIDDLE PARK WATER CONSERVANCY DISTRlCT Water Allotment Contract (Windy Gap Standby) Wolford Mountain THIS CONTRACT is made and enterad into this 30th day of June' , 2003 by and between the BOARD OF DIRECTORS OF MIDDLE PARK WATER CONSERVANCY D1STRICT, hereinafter referred to as "Middte Park", and summit County GoVernmeat hereinafter referred to as "Applicant"; W ITNESSETH: WHEREAS, Middfe Park rs one of the signatories ta an agreement dated the 17th day of December, 1992, with the Colorado River Water Conservation District and Baard of Caunty Commissioners of Grand County, which Agreement is fulfy incorporated herein and hereinafter referred to as the Agreement; and WHEREAS, Middle Park receives certain benefrrs and obiigations under said Agreement; and' WHEREAS, the Agreement provides Middle Par1c an interest in 3,000 acre-#ee# by alIowing it to be placed in WaItord Moun#ain Reservair, as more particulariy set forth in said Agreement, and Woiford Mou.ntain Reservoir was adjudicated by the Colorado River Water Conservation District in case number 87CW283 and ofiher cases, Water Division No. 5; and WHEREAS, Applican# is interested in purchasing from Middle Park a;certain partion of the water that is designated to be stored in WoEford Mountain Reservoir subject to the terms and conditions of said Agreement and this Contract; anef . WHEREAS, Applicant has, prior to execution of this Contract, performed whatever studies it deems necessary to determine that the engineering assumpfions, and 3egal effect of said Agreement will result in usabie water to said Appiicant from Woiford Mountain Reservoir which water wiil be adequate for the purposes and uses contemplated by Appficant; and WHEREAS, Applicant has an existing Windy Gap Contract and this Contract is valid only as iong as Applicant continues said Windy Gap Cantract in fufl force. _ Summit Exhibit 4 -
