TMH <br />has alleged that --he operation of the substitution from Wolford <br />Mountain Reservoir fcr water that would otherwise be released from <br />Green Mountain Reservoir could impact the TMH water rights. TMH has <br />also alleged that -L-rie operar-ion of exchanges from Wolford Mountain <br />Reservoir to pair.cs upstream of the TMH water rights could impact <br />diversions by the TMH water rights. <br />By stipulation dated August 28, 1992, .TMH and the Co-Applicants <br />have agreed to resolve the iitigation among and between them. The <br />stipulation provides that TMH will not object to nor interfere with <br />substitutions or exchanges of water made pursuant to the MOA, so <br />long as such substitutions or exchanges are operated pursuant to the <br />following terms: <br />16.1 By February 1, of each year, TMH will provide data <br />to the Board and the River District which states on a daily <br />basis for the preceding year, that either or both of the Blue <br />Valley Rancr Hydro Power projects identified as FERC Projects <br />No. 4316 ana 4444 were operating. <br />16.2 By April !-, or as soon thereafter as the necessary <br />hydrologic Idata become available, the Board will submit a <br />report to TM'g and the River District which tabulates the data <br />as required b,r the "Determination oi Power Tnterference <br />12
