Gibson - Manager <br />October 7, 2008 <br />Enclosed is a copy of the Contract and four (4) copies of the signature pages of the <br />subject Contract, and Appendices 2& 4. <br />In addition, enclosed are: <br />• An Attorney Opinion Letter from Tod Smith, Esq., attorney to the San Luis Water <br />Conservancy District (District). <br />• Completed W-9 <br />• Completed Authorization Agreement for Automatic Deposits <br />• A cancelled check from the District's bank account <br />• A Certificate of Insurance, showing the District's coverage through December 31, <br />2008. <br />As a condition of the CWCB granting the loan there is a requirement that the District <br />demonstrate that it has a reservoir storage agreement covering its augmentation water, <br />and specifically for the a augmentation water that will result from the purchase of the <br />water rights with the subject loan. <br />The District is in the final negotiations with the Santa Maria Reservoir Company for a <br />Lease Agreement that will provide 1,000 acre-feet of firm storage. The delay in <br />finalizing this Agreement is partially due to the Santa Maria Reservoir Company's <br />attorney being engaged in a third party law suit that may delay his attention to this <br />matter for as long as two (2) weeks.
