<br />R[;SULU"['lON <br />Resolution No. 2000- <br />A RESOLUTIOI~i OF THE SILT WATER CONSERVANCY DISTRICT WATER <br />ACTNITY ENTERPRISE, AUTHORIZING AND APPROVING A LOAN BETWEEN THE <br />ENTERPRISE AND THE COLORADO WATER CONSERVATION BOARD. <br />WHEREAS, the Silt Wa ter Conservancy District ("District") established the Silt Water <br />Conservancy District Wa terActivity Enterprise ("Enterprise") as authorized and referenced <br />in Section 37-45.1-101, etseq., of the Colorado Revised Statutes (1999), and Artic~e X, Section <br />20 of the Colorado Constitution; and <br />WHEREAS, the Colorado Water Conservation Board ("CWCB") has agreed to <br />extend a loan of $100,000.00 to the Enterpt•ise to help finance the rehabilitation of a water <br />diversion and delivery system; and <br />WHEREAS, the Enterprise is autho°~ owered by Section 37-45.1-104, <br />C.R.S. (1999) to incur indebtedness in the p~f its operations; and <br />WHEREAS, the loan to the Ente il o i debtofthe Districtwithin <br />the meaning of any constitutional or s o i~oviston or timitaHon; and <br />WHEREAS, the loan is to be repaid exclusively from revenues generated and <br />collected from water system service fees, rates and charges; and <br />WHEREAS, the District, through the operation of the Enterprise, is to maintain <br />separate and distinct records a nd funds respective to Enterprise expenditures and revenues; <br />and <br />WHEREAS, the L:nl~rprise c~esires lc~ appr~ve th~ CWC13 loan and undertake those <br />con~mitil~~nts aizd actions necessary to eFtectuale and implement the same. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SILT WATER CONSERVANCY <br />DISTRICT WATER ACTIVITY ENTERPRISE, AS FOLLOWS: <br />Resnlution <br />Silt l\%nFrr (~nn.ti~~rt~nnry Di~h•i~~t 6Vrrtc~r• Activity EnterE~risc <br />''"~"' Appendix A to Loan Contract C150030 <br />
