This agreement is <br />administratively complex because it involves the States of Colorado, Wyoming, Nebraska, the United States <br />Department of Interior, and the Contractor, Nebraska Community Foundation. Due to the lengthy <br />negotiations needed to develop and Endangered Species Program the agreement needs to be amended until <br />July 31, 2005. Based on my understanding of the situation this timeframe may be inconsistent with the State <br />Procurement Rules because of the length of the agreement. Consequently, I have also included a Sole Source <br />Justification to allow the Amendment to move forward. <br />I apologize for the late routing of the contract. However, the negotiations have been very contentious and in <br />recent times it was not clear that all the parties would continue along the current path. I realize that the <br />Endangered Species Partnership has been a protracted process but I would emphasize that this program still <br />appears to provide the best mechanism to address endangered species compliance issues, which in turn will <br />provide regulatory certainty for Colorado's South Platte water users. <br />Thank you for you assistance in this important matter.
