Outline of Concepts to Include in an MOA between SPWRAP and Colorado <br />• The Governar will sign the program document, binding the State, but SPWRAP will be <br />providing the funding. This MOA should be signed before the State signs the program <br />document and the MOA should provide that SPWRAP will commit funds unless and <br />until additional funding becomes available to the State through the Species Conservation <br />Trust Fund or other appropriate funds. That way, the State will have an interest in the <br />funding source that it will commit by the signing of the Program document. <br />• The MOA must include specific terms under which the State will reimburse SPWRAP <br />and/or take over future funding of the program should funds become available through <br />the Species Conservation Trust Fund or other appropriate funding. <br />• The MOA should describe that the State is committed to (and will be responsible for) <br />achieving the milestones that commit the State to completing construction of Tamarack, <br />implementing the Water Action Plan, implementing the Land Plan, and operating the <br />Future Depletions Plan. <br />• The MOA should commit SPWRAP to funding the IMRP (Integrated Monitoring and <br />Research Plan) and AMP (Adaptive Management Plan), but the MOA should <br />contemplate if SPWRAP is unable to meet its financial obligations, that the State would <br />use best efforts to provide financial resources, but include the typical disclaimer that the <br />State cannot commit to financial resources in future years in advance of those year. <br />• The MOA should refer to the MOA (on which DOW is working) and identify that <br />operations and maintenance at Tamarack will be managed in the way as specified in that <br />other MOA. <br />• The MOA should describe how the Governor would choose the GC rep and alternate, and <br />likewise, how SPWRAP would choose the GC rep and alternate.
