Central will make water available from the Environmental Account as <br />follows: <br />(A) POINT AND ROUTING OF DELNERY: The point of delivery <br />shall be the Kingsley Dam oudet facilities. After delivery, and consistent with the <br />Enviromnental Account Document and the Administrative Plan for Managing Water <br />Commitments (hereinreferred to as "Admuustrative Plan") as approved by FERC, Central <br />may route water from the Environmental Account to the habitat area between Overton <br />and Grand Island via the North Platte and Platte Rivers, or via the Central Supply Canal <br />for return via the Johnson No. 2 Return or Jeffrey Return. Rouring shall be at Central's <br />discretion except that Environmental Account water will be routed through the Jeffrey <br />Return pursuant to section III.A.10 of the Envirorunental Account Document, if the <br />Enviromnental Account Manager so requests in accordance with the procedures in the <br />Administraave Plan for making such a request. <br />(B) AMOUNT: On the day requested, Central will release, from water <br />made available in the Environmental Account in Lake McConaughy by appropriations <br />granted Central by the State of Nebraska for such purposes, whatever amount of <br />Envirorunental Account water may be requested by the Enviromnental Account Manager <br />consistent with water right A-17695 and the Environmental Account Document, and with <br />the procedures for making such requests in the Administraave Plan. The amount of water <br />released shall be measured at the point of release from Lake McConaughy and debited <br />against the total in the Enviromnental Account. Consistent with section III.A.9 of the <br />Environmental Account Document, nothing in this agreement shall preclude Central or <br />the Nebraska Public Power District from diverting Environmental Account water for <br />beneficial use subject to the conditions of sections III.A.9 and .10 and rhe <br />communications and record-keeping requirements of the Administrative Plan. Releases <br />shall also be contingent upon the following conditions: <br />(1) The Environmental Account Manager shall specify the <br />amount of the release as set forth in the procedures governing requests for releases in the <br />Administrative Plan approved by FERC; <br />(2) Central shall be released from its obligation to release water <br />upon the request of the Environmental Account Manager if and to the extent that the <br />requested amount is beyond the physical limita.tions of its system, or if events occur which <br />limit or prevent Central's ability to provide them as set forth in secrion TI.C.2.a. of the <br />Enviromnental Account Document, and subject to the communications and record- <br />keep'ing requirements of the approved Administrative Plan; <br />(3) Consistent with section II.C.2.c of the Environmental <br />Account Document, the Environmental Account Manager may not request releases from <br />the Environmental Account when the Platte or North Platte River at Keystone, North <br />Platte, Brady, Cdzad, Kearney or Grand Island are at or above flood stage as defined for <br />those locations by the National Weather Seivice (NWS), or when releases would cause <br />the Platte or North Platte River to rise above flood stage at any of those locaaons. If the <br />Environmental Account Manager requests a release of Envirorunental Account water that <br />Central believes would cause the Platte or North Platte River to rise above flood stage, the <br />request for release may be denied under the circumstances and procedures of secaon
