ir <br />The delay in moving this modification forwazd was a result of receiving a modificztion that was not <br />formatted i.-i a rnanncr that is routinely used by Colorada. Z appzoached the other parties with a propasal <br />that wQuld have forznatted the madification in a manner more xautine for Colorado. The other parties, <br />especially the federal gove=nment, were concerned about using a"zoutine CoIorado format" because rhey <br />and fihe othez states (Wyoming and Nebraska) have not used Colorado's forrnat. As a compromise, based <br />on discussions between Mr. Goodnough and Mr. Holr:nan, Colorado has agreed that we can use the <br />federal modificarion form with the condition that the appropriate sidnature lines be added and the relevant <br />signatures obtai.ned. - Unfortunately, the resolution of t:ais issue extended beyond the original performance <br />period. I apologize for this delay. <br />In the process of negotiating and evaluaang the processes needed to extend the period of performance I <br />identified tb,at two previous modifications to the Agzeement had been processed, The first modification <br />was to clarify the Federal Govemments funding commitrnent. The second rnodific-ation was <br />administn.tive in nature an involved givi.ng more definitive d'uection on the tinvng for calculating and <br />accessing admjinzstrative fees. Si.nce Modification 001 only :nvolved a clarificati.on on funding for the <br />federal govenunent I have been told that Coloxado does nat need to take any action on this. Modification <br />002 is attached and will be routed with a distinct CLIN nurnber. Modificarion 003 will be routed with a <br />distinct CLIN number. Finally, I would like to exglazn that I think that tile two previaus modifications <br />(001 and 002) were not routed for fizll signatures because previaus staff believed that they had signature <br />authority. I believe this issue has been resolved. I have attached the ori$inal Agreement and Modifications 002 and 003 (Exhibit A) with the additional <br />*equired signature blocks. I would like to also let you know that I anticipate a future modification to the <br />scope and budget of the Agreement within the next 6 months. It wiii be my goal to obtain gzeater clasity <br />and understanding on the administration of the Agreement during this process. <br />Thank you for your assistanee an this dif'xcult issue.
