<br />Administrative Support to the Governance Committee and Executive Director for the Platte River Endangered
<br />Species Partnership
<br />THIS AMENDMENT, made this 10 day of Apri12007, by and between the State of Colorado for the use and
<br />benefit of the Department of Natural Resources, Colorado Water Conservation Board, 1313 Sherman Street,
<br />Room 721, Denver, CO 80203, hereinafter referred to as the State, and Nebraska Community Foundation, 317
<br />South 12t' Street, Suite 200, Lincoln, NE 68508, hereinafter referred to as the contractor,
<br />FACTUAL RECITALS
<br />Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a
<br />sufficient unencumbered balance thereof remains available for payment; and
<br />Required approval, clearance, and coordination has been accomplished from and with appropriate agencies; and
<br />The parties entered into a contract dated July 1, 1999, for financial management and administrative support in
<br />the implementation of the July 1997 Cooperative Agreement for Platte River Research and Other Efforts
<br />Relating to Endangered Species Habitats Along the Central Platte River, Nebraska, the purpose for this
<br />amendment is described below.
<br />Then in December 2006, the parties signed the Platter River Recovery Implementation Program Agreement,
<br />which initiated the Program on January l, 2007.
<br />The purpose of this modification is to add fund, Platte River Implementation Program, and specify the
<br />disbursement of funds for services during the transition to the Program's first increment. Current services will
<br />continue to be provided unchanged until such time as they are completed and the parties have entered into a
<br />new financial assistance arrangement. The Nebraska Community Foundation will continue to disperse funds.
<br />WHEREAS, the parties are in the process of determining how they will seek a Financial Management Entity for
<br />implementing the Program, and that process may take up to a year to complete.
<br />NOW THEREFORE, it is hereby agreed that
<br />1. Consideration for this amendment #5 to the original contract, (PDA 00-00002 Contract Routing Number),
<br />(Contract Encumbrance Number, C153878), dated July 1, 1999, Amendment #1, dated October 27,1999,
<br />Contract Routing # Ol PDA 00024, Amendment #2, dated December 4, 2003, Contract Routing #04 PDA
<br />00035, Amendment #3, dated May 12, 2004, Contract Routing #04 PDA 00075, Amendment #4, dated
<br />March 31, 2006, Contract Routing #06 PDA 00073 consists of the payments which shall be made pursuant
<br />to this amendment and the promises and agreements herein set forth.
