Purcell said that the ED is authorized to proceed if he believes it is worth <br />• the investment. <br />Platte River Boundarv Issues <br />Kenny introduced Dave Smith and said he asked him to give the GC a presentation on <br />"Boundary Issues 101 ". Smith said he practiced in Dawson County his entire career and there <br />has always been a debate as to whether anyone could even buy/sell accretion ground. This is <br />important now because of the value of land along the Platte, so it is important to have good <br />boundary determinations. Smith went through some key legal definitions and an evaluation of <br />key legal cases important to boundary determinations. Smith said it is important that when the <br />Program considers land, you do a lot of looking, talking, and investigating to know the facts of <br />the specific area. Hopefully, management actions will be considered avulsion so that boundary <br />lines do not change. <br />Purcell asked about the statement that if north side and south side landowners agree, that land <br />has more value because everyone knows what they have. Smith said the current price-setter in <br />Dawson County is $3,000/acre, but that realtors he knows say if everything is known, it may <br />jump to $10,000/acre; Kowalski asked if there was any discussion in the Nebraska legislature <br />about dealing with this issue. Smith said yes, but that nobody wants to touch it because no <br />matter how many acres are involved it will always be a source of conflict. Smith said the best <br />way to resolve these conflicts is by agreement between the landowners. <br />Previous GC Action Items <br />• Kenny discussed the Continuing Services Agreement with WEST, Inc. He said it did not require <br />further action on the part of the GC, but disclosure to the GC. Kenny reported that an agreement <br />to provide continuing services from WEST for ongoing administrative, procedural, and other <br />items has been executed. Kenny and Dale Strickland established a$75,000 budget. A portion <br />($25,000) is for whooping crane monitoring data analysis. $50,000 was moved from other <br />budget areas where funds are available and unlikely to be expended in FY 2007. Purcell said <br />this still seems to be an action item because it is a budget item. The GC gave approval to <br />move ahead. <br />Chad Smith reported on the status of the stage change study, providing an update as to the <br />discussion at the AMWG and TAC meeting and the status of the RFP. Bleed said she wants to <br />review the RFP, so she suggested that after Smith incorporates comments from the stage <br />change study sub-group he should send it to the TAC, WAC, and interested GC members <br />for flnal review. Purcell said when the small GC group interested in the stage change study <br />is ready, then the RFP can be put out on street. <br />Purcell said he has an opportunity to lease grazing on the Wyoming property to pay the taxes. <br />He said he needs to get an agreement to LIHE that the Program will become the management <br />entity. Purcell said he wants a report at the December GC meeting from Smith with <br />confirmation of plans for adaptive management work on the Wyoming property and how <br />that might be impacted by one-year grazing lease.
