of further development of the Project in accordance with the Development Plan, <br />along with an estimate of operations and maintenance costs, for current and <br />future Project features including manpower at various levels of development. <br />III. FACILITY PERMITTING <br />1. The other parties to this MOU and the Operating Committee will assist CDOW <br />in securing any needed permits and approvals. These include, but are not <br />limited to; applications for federal assistance, well permit applications, substitute <br />supply plans, and water rights applications. All such permits/approvals will be <br />filed in the name of the CDOW. <br />2. The Operating Committee will assist the CDOW by providing: A) technical <br />assistance through the preparation of engineering analysis and reports in support <br />of all well permit applications, substitute supply plans, and water right <br />applications. Such analysis may include, but not be limited to, streamflow <br />depletion/accretion analysis and water accounting procedures; and B) expert <br />testimony as necessary to assist CDOW in its efforts to obtain a decree or <br />decrees from the Water Division No. 1 Water Court, thereby adjudicating the right <br />to operate the recharge facilities for the purposes contemplated under this <br />agreement. <br />IV. MODELING <br />1. The parties to this MOU along with the Northern Colorado Water Conservancy <br />District (NCWCD) and Colorado State University (CSU) are currently studying the <br />site characteristics of the TRSWA through development of a finite-difference <br />groundwater model. This effort will be coordinated through the Operating <br />Committee. <br />V. DEVELOPMENT <br />1. The parties to this MOU and the Operating Committee must approve further <br />construction of Project facilities and any material deviations from the <br />Development Plan. <br />2. The construction and installation of all wells, pumps, pipelines and ponds <br />necessary to develop the managed groundwater recharge projects on the SWAs <br />will be subject to the following limitations and conditions: <br />A. Installation of a monitoring well nefinrork to collect data for analysis of <br />accretive or depletive effects of the operafiion of the Project facilities on the South <br />Platte River and the effects of operation of the facilities (i.e., well pumping and <br />recharge) on warm water sloughs. <br />4 Tamarack MOU - 2002
