Modification No. 004 <br />Cooperative Agreement No. 99-FC-60-11870 <br />Colorado Financial Provisions: <br />As set forth in Section B.2.g. of this agreement and Table l, Appendix B, of the July 1997 Cooperative <br />Agreement for Platte River Research and Other Efforts Relating to Endangered Species Habitats Along the <br />Central Platte River, Nebraska (Table 1 modified by Governance Committee action as shown in Exhibit <br />l,which is page 7 of the Governance Committee meeting minutes of October 29-30- 2003, and the October <br />527, 2005 extension document and attachments), the State of Colorado's share of the "other cash" budget is <br />$674,997.24 or no more than 15.79% excluding the cost for Fluvial Geomorphological Investigations. The <br />Governance Committee and representatives for the Cooperative Agreement have agreed that the States of <br />Colorado, Nebraska, and Wyoming will fund the Fluvial Geomorphological Investigations. Each state will <br />provide no more than $100,000.00 each or 33.33% of the cost of said investigation. As set forth in Section <br />D.1 of this agreement, as modified, the state and federal representative for the agreement and the Nebraska <br />Community Foundation may agree in writing to modify individual budgets within the total budget set forth <br />above, provided that the State of Colorado's expenditures under this agreement shall not exceed $774,997.24 <br />For the State of Colorado authority for the original contract, as amended, and budget of $700,000.00 exists in <br />the law in Fund Number 12H, Agency PAA, APPR code PRB,GBL PRB, Object Code 1920, Contract <br />Encumbrance Number PAA C153878, and additional funds ($74,997.24) exist in Fund Number 100, Agency <br />PDA, APPR code 018, Program WTRC, Object Code 1920, Contract Encumbrance Number PDA C153878. <br />As of December 31, 2005, Colorado has contributed $623,028.92 toward the "other cash" portion of the <br />Cooperative Agreement and $100,000.00 for the Fluvial Geomorphological Investigation for a total <br />contribution to date of $723,028.92. Therfore, there is a balance of $51, 968.32 remaining from Fund 12 H, <br />PAA and under Fund 100, PDA, combined. Authority for the remaining balance exists under Fund 12 H, <br />PAA and under Fund 100, PDA. <br />Authority for the additional $37,489.00 exists in the law and funds have been budgeted, appropriated and <br />otherwise made available and a sufficient unencumbered balance thereof remains available for payment. <br />Page 2 of 2 <br />W.- - -- -
