Land Entity Wiiite Paper <br />November 30, 1999 <br />Under this option, Nebraska would be disproportionately represented, but other <br />than fnancing, the impacts of the land component fall on Nebraskans alone. Adding a <br />sea# on the Governance Committee may be particularly appealing if it retains a strong <br />role in Iand prog3ram decision-making. <br />2. Representatean in the LOC or Board af a Slrong Lartd Entrty <br />If organizational options 1 or 3 are selected above, representation will need tv be <br />worked out for a body with significant decision-making pawers -- either the board of <br />directors of a strong Land Entity or the membership of the LOC. There are a number of <br />aptions available for consideration. They include, but are no# limited to: <br />• Govemance committee membership plus one or more landowner representatives, <br />with decisions made by a super-majority which must inciude all four governments <br />ta reach an afFirmative decision. The super-majority could be constnicted so that <br />the landowner representatives have a veto over "palicy" decisivns (or nut). <br />+ Signatories plus one environmental group plus two local landowners plus a <br />representative of entities dedicating lands to the Program that will coordinate <br />tE3rough the L4C ar Land Entity (perhaps far now, NPPD, as owner of <br />Cottonwood Ranch). A voting structure could be selected so that "policy" <br />decisions are made by agreement of all four gavemrnents, one landowner and one <br />other cammittee member. <br />• Signatories plus five landowner representatives. A simple majority could be used <br />to reach any decision. <br />3. Representation in a Land Ertlity Bvatd for a Land Entity with <br />Limited Functiarts <br />If much of the decision-malcing authority is reserved to the Governance <br />Committee or to a Land Oversight Committee, the options above are available to govem <br />a Land Entity with timited responsibilities, but governance af the Land Entity may also <br />reasonably be dravm from a narrower group, such as: <br />• Majority landowner representatives. <br />+ All ar nearly all Nebraska representatives <br />? States, environmental representative, landowner representatives, no federal <br />representatives to avoid conflict/waiver paperwork. <br />75
