' '• 3. Sorting Out the New EnEity Options
Of the new entity options, the ones that may be of greatest interest to the
Governance Commithee are those which are the most straight forward and
establish a neutral, direct fiduciary responsibiiity and acCOUntability to the
Governance Committee. The two options that accomplish these objectives are the
establishment of a supporting nonprofit foundation and establishment Qf a
nonprafit trust. It is also rnore likely that these twa structures wzll not require
specific federal or state enabling authority, but this cjuestion shauld be referred to
each juxisdiction for resalution. A supporting faundation or a trust are both
potentially more neutral, passive and controliable than an existing independent
nonprofit organization. In addition, both cauld be established under the Nebraska
Community Foundation if that were judged to be desirable. There are already
exzsting relationships with the Cnrnmunity Foundation and they could help
pravide Iegal, accounting and clerical support to the new effort so that it would nat
be starting from sCratch. The relationshzp to the Cammunity Foundatian might
also assist with local understanding of the land holding entity.
Conservation Partners, Inc. P. 14
