necessary for SPWRAP to meet shartfalls, SPWRAP will make such
payments directly to PRRIP on Colorado's bchalf. The Parties acknowlcdge
that failure to meet the monetary obligations owcd to PRRIP may result in
suspension of PRRIP benefits and passible regulatory action by federal
agencies against Colorado, or watcr users within Coloraclo, undcr the ESA.
d. Human Resources. PitRIP contemplates that Calorado's interests will be
represented by two members of the Governance Committee: One member is to be
selectcd by the State of Colorado and one is to be sclected by SPWRAP. Thc
Parties will consult with euch other regarding the selection of these Governance
Committee members.
i Colorado and SPWRAP will continue to cooperate in the formulatinn of
Colorado's positions on the implementation of the First Increment as well as
the components of any later increments.
ii During the process of negotiating the PRRIP, a numbcr of individuals with
relevant expertise have been made available by DNR, and by SPWRAP and
its members. To tiie extent they believe they are able, DNR, SPWRAP ancl
members will continue in the future to provicic persons with such expertise to
assist with negotiations, provide information and counsel to Governance
Committee members for Colorado and the Colorado water users, and to
participate on advisory committees of PRRIP.
iii At varinus times during the development of the PRRIP, Colorado water users
have, at their own expcnse, met with federal legislators and natural resource
agencies to urge them to continue and/or increase the fedcral partion of the
funding necdcd to operate the PRRIP. SPWRAP wili continue such efforts as
appropriate, and the Parties will coordinate in that regard.
iv Activities in Colorado to meet PRRIP obligations add further demands for
human resourres beyond those needed during the negotiation and
development of F'RRIl'. Some of these demands may be met throuah
consultants or other indcpendent contractors; others may be met through use
of employees of Colorado or of SPWRAP members. Further agreements
betwcen the Parties regarding how these human resources demands will be
mct may be ncccssary.
e. AccountinQ. The PRRIP requires Colorado to account for the water it re-regulates
for program purposes, and requires collection and reporting of data pertainjng to
population growth, water sources being relied upon for supplying new growth, the
acreage of irrigaled agricutture and other matters. The Operating Comraittee wiil
develap and propose a proc;ess for collecting and analyzing relevant data and
reducing it to a farm suitable for submission to the Governance Committee.
SPWRAP will require its membcrs to report information related to the Program
reporting requircments as requested by the Operating Committee. The parties
