create some icvel of continuity, within 30 days foltowing the execution of this
MoA, the C'oloracio Watcr Gonservation Qoard, the Division of Wildlife, and
SPWRAP wiU each dcsignate a primary and an aitematc Opcrating
C'ammittee contact person, and these indiv'sduals will coordinate meetings of
the Opcrating Committcc. The Operating Committcc may choose to crcatc
subcommittees to rocus on certain subject areas if it determines that doing so
is advisable.
ii It is anticipatcd that on most issues the Operating Committcc will be able to
reach a consensus, and such determinations will be ratified by DNR and
SPWRAF. ln the event the Opcrating Cammittee is unable to reach a
consensus, appropriate membcrs of the Operating Committee will prescnt the
competing solutions or detcrnlinations to the Dircctor of the llNR and the
SI'WRAP board. DNR and SPWRAP will thcn agrcc on a resolution of the
issuc. "Chrough this procedure, u4timately, all decisians will be made by
conscnsus.

program tu re-time or re-regulate [lows in the lowcr South I'lattc River is an
importaiit element of the PRltIP within Colorado. The Partics will agree upon a
plan f'or meeting C'olorado's re-regulation obligations (thc "Water Projects Plan"
fon»erly known as the "Tamarack P{an") based on rccommendations of the
Operating Committcc. Tlie Parties acknowledge that the Water Projects Plan may
evolvc vvcr the course of the First Increment, ncvertheless, the Parties will scck to
have an iiiitial Watcr Projects Plan in piace by January 1, 2008. The Operating
C'ommittec will also develop an appropriate mcans of documenting the Parties
aereement on the initia) Water Projects Plan, incluciing amendments thercto.
Furthcr agrccments betwccn UNR or sub-agcncics within DNR, SYWRAl' and
perhaps third parties may be cmcrcd to implement the Water Projects Pian.
Une such anticipated further agreement invoives the Colorado Division of
Wildlife ("CU0W") pertaining to the use of the 'Camarack Ranch State
Wildlife Arca and thc Pony Express Statc Wildlife Area, along with certain
wclls and related recharge facilitics located thereon. SPWRAP and UNR
acknowicdge that use of these facilitics for PRRIP purposes cannot violate the
requircments of the Pittman-Robcrtson Wildlife Restoration Act by interfering
with the primary use and management of the propcrtics for the wildlifc
purposcs by thc C'UOW. '
