use. The courts will ultimately determine whether an instream t
flow program-for recreation constitutes imposition of riparian
water law, contrary to the Colorado Constitution. Hut the
Supreme Court's decision upholding the CWCB minimum stream flow
program is evidence that a carefully drawn statutory program will
be upheld.
It is time to consider and pass State legislation for
an adequately funded recreational waters program to be
administered by an agency such as the State Board of Parks.
Water for wetlands can be addressed through the CWCB program and
a variety of land ownership and existing regulatory mechanisms.
Instream flows should not be allocated for water pollution
dilution as this would elevate pollution to the status of a
beneficial use and discourage source control. Water quality
problems should continue to be addressed through point source
permit requirements and best management practices for non-point
sources.
-32-
