<br />use. The courts will ultimately determine whether an instream t <br />flow program-for recreation constitutes imposition of riparian <br />water law, contrary to the Colorado Constitution. Hut the <br />Supreme Court's decision upholding the CWCB minimum stream flow <br />program is evidence that a carefully drawn statutory program will <br />be upheld. <br />It is time to consider and pass State legislation for <br />an adequately funded recreational waters program to be <br />administered by an agency such as the State Board of Parks. <br />Water for wetlands can be addressed through the CWCB program and <br />a variety of land ownership and existing regulatory mechanisms. <br />Instream flows should not be allocated for water pollution <br />dilution as this would elevate pollution to the status of a <br />beneficial use and discourage source control. Water quality <br />problems should continue to be addressed through point source <br />permit requirements and best management practices for non-point <br />sources. <br />-32- <br />
