34 <br />5. Initiate discussions with the Service after the conclusion of the 5-year <br />research program to examine further refinement of flows for the <br />endangered Colorado River fish. ' - <br />Flows were established year-round based on the best scientific and <br />commercial data currently available. Yet quhstions-riemain pertaining to <br />the winter and spring periods. Current data indicate the need for a <br />spring peak, although the nature of the peak (magnitude versus duration) <br />may still need refinement. Historically, winter flows were low and <br />stable in the Green River. Questions regarding the effects on the <br />endangered fish of deviating from low and stable winter flows need to be <br />addressed. Therefore, further research is imperative for these periods <br />to ensure that the flows required to preserve and recover the endangered <br />fish will eventually be in place. <br />Formal Section 7 consultation must be reinitiated if: <br />a. the amount or extent of taking specified in the incidental take <br />statement is exceeded; <br />b. new information reveals effects of the action that may affect listed <br />species or critical habitat in a manner or to an extent not previously <br />considered; <br />c, the identified action is subsequently modified in a manner that causes <br />an effect to the listed species or critical habitat that was not <br />considered in the biological opinion; or <br />d. anew species is listed or critical habitat designated that may be <br />affected by the identified action. <br />Although the Yampa River flow regime is used to cue releases from Flaming <br />Gorge Dam, this opinion does not pre3udge future development in the Yampa <br />River. Any such development will require Section 7 consultation in compliance <br />with the Act. <br />CONSERVATION RECOMhIENDATIONS <br />In order to avoid adverse effects of long-term operation of Flaming Gorge Dam <br />on the rare and endangered fish, the Service makes the fo]lowing <br />recommendations. _ <br />1. Reclamation should examine methods for opening fish access to <br />backwaters and flooded bottomlands during high releases. Salt cedar <br />establishment reduced fish access to habitats off the main channel. <br />The methods may include salt cedar removal or opening channels <br />through the salt cedar and obtain any necessary flowage easements. <br />
