U.S. Fish and Wildlife Service, Region 6, Denver. <br />Colorado <br />Subject: Final Biological Opinion, Duchesne River Basin, Utah <br />Section 7 (a) (1) of the Endangered Species Act of 1973, as amended, directs <br />Federal agencies, in consultation with and with the assistance of tale <br />Secretary of the Interior, to utilize their authorities to further the <br />purposes of the Act by carrying out conservation programs far listed species. <br />Section 7 (a) (2) of the Act requires every Federal agency, in consultation <br />with the Secretary, to insure that any action it authorizes, funds, or carries <br />out is not likely to jeopardize the continued existence of any listed species <br />or result in the destruction or adverse modification of critical habitat. <br />Pursuant to 50 CFR 402.16, reinitiation of formal consultation is required and <br />shall be requested by the Federal agency or by the Fish and Wildlife Service <br />where discretionary Federal involvement or control over the action has been <br />retained or is authorized by law and: a) if the amount or extent of taking <br />specified in the incidental take statement is exceeded; b) if new information <br />reveals effects of the action that may affect listed species or critical <br />
