address the necessity of simultaneously and successfully interpreting biological <br />and engineering technical data? <br />CWCB Discretion When Flow/Population Causal Linkage Is <br />Uncertain. How much latitude does the CWCB have in addressing situations <br />in which it is not feasible to establish relationships between flow, fish population, <br />and habitat? In working with these situations, how should the Board <br />simultaneously and fairly interpret both biological and engineering technical data? <br />Interim Instream Flow Rights. How should stakeholders <br />explore the possibility of acquiring "interim" instream flow rights <br />subject to future review and refinement based on new data? In so <br />doing, the following issues must be addressed: (A) Would interim <br />flow rights adequately protect habitat until uncertainties are <br />resolved? (B) Can USFWS rely on interim flows in issuing its <br />biological opinions ? (This issue is subsumable under the broader <br />questions of CWCB discretion raised above). <br />Impact of Instream Flow Protection on Colorado's Ability to <br />Develop its Compact Apportionment. How should stakeholders address a <br />variety of potential conflict areas between the protection of instream flows for the <br />endangered fishes and Colorado's ability to develop its compact apportionment, <br />including: <br />(A) timely stream-by-stream identification of Colorado's compact apportionments; <br />(B) instream flow protection for fish habitat pending quantification of the stream- <br />• specific stream-specific compact apportionment; <br />3-3 <br />
