MEMORANDUM OF AGREEMENT <br />FOR DEVELOPMENT OF A <br />LOWER COLORADO RIVER <br />SPECIES CONSERVATION PROGRAM <br />THIS MEMORANDUM OF AGREEMENT IS ENTERED INTO BY THE UNITED <br />STATES OF AMERICA, represented by the DEPARTMENT OF THE INTERIOR <br />0 (INTERIOR); the STATE OF ARIZONA (ARIZONA), represented by the ARIZONA <br />DEPARTMENT OF WATER RESOURCES and ARIZONA GAME & FISH <br />DEPARTMENT; the STATE OF CALIFORNIA (CALIFORNIA), represented by the <br />COLORADO RIVER BOARD OF CALIFORNIA and the CALIFORNIA <br />DEPARTMENT OF FISH & GAME; and the STATE OF NEVADA (NEVADA), <br />0 represented by the COLORADO RIVER COMMISSION OF NEVADA and the <br />NEVADA DIVISION OF WILDLIFE. <br />I. PURPOSE <br />0 <br />The purpose of the Memorandum of Agreement (MOA) is to initiate the development of a <br />Lower Colorado River Species Conservation Program (Program), which will accommodate <br />0 current water diversions and power production and optimize opportunities for future water <br />and power development, while working toward the conservation of habitat and toward the <br />recovery of included species, and reducing the likelihood of additional species listings. The <br />Program planning area encompasses the portion of the mainstem Colorado River from below <br />Glen Canyon Dam to the Southerly International Boundary, including the 100-year floodplain <br />and reservoir full-pool elevations within the states of Arizona, California, and Nevada. The <br />signatories' intent is to: <br />0 0 exercise creative, flexible options under the Federal Endangered Species Act <br />0 <br />(Act) so that existing water and power projects and activities, as well as future <br />opportunities for development, are in compliance with applicable State and <br />D APPENDIX D
