RESOURCE MITIGATION SITE TO OFFSET PROJECT IMPACTS OR LOSSES,
THE CLERK AND RECORDER OF THE BANK SHALL NOTE IN THE RECORDS
THAT SUCH CREDITS HAVE BEEN USED AND ARE NO LONGER AVAILABLE
FOR FURTHER USE ON OTHER PROJECTS. IN THE EVENT THAT SUCH
PERMIT MAY BE INVALIDATED OR RELINQUISHED, IN WHOLE OR IN
PART, SUCH CREDITS MAY BE RESTORED TO THE BOOKS AS POTENTIAL
CREDITS IN WHOLE OR IN PART WITH THE APPROVAL OF THE EXECUTIVE
DIRECTOR.
37-85.5-109. Powers of local government. NOTHING IN THIS
ARTICLE SHALL BE CONSTRUED TO PREVENT, SUPERSEDE, ABROGATE, OR
OTHERWISE RESTRICT THE LEGAL POWERS OF LOCAL GOVERNMENT TO
GRANT OR DENY LOCAL PERMITS, TO ESTABLISH LOCAL LAND USES,
INCLUDING ZONING, AND OTHERWISE TO EXERCISE ALL LOCAL
GOVERNMENTAL POWERS, DUTIES, AND RESPONSIBILITIES.
37-85.5-110. Permits. NOTHING IN THIS ARTICLE SHALL BE
CONSTRUED TO APPLY TO GROUP EVENT PERMITS AND RECREATION EVENT
PERMITS ISSUED BY THE FOREST SERVICE OR SPECIAL RECREATION
PERMITS ISSUED BY THE BUREAU OF LAND MANAGEMENT.
37-85.5-111. Repeal of article. THIS ARTICLE SHALL BE
REPEALED, EFFECTIVE JULY 1997.
SECTION 2. Appropriation. In addition to any other
appropriation, there is hereby appropriated, out of any moneys
in the resource mitigation banking cash fund not otherwise
appropriated, to the department of natural resources for
allocation to the executive director of the resource
mitigation bank, for the fiscal year beginning July 1, 1991,
the sum of thirty thousand five hundred nineteen dollars
($30,519) and 0.5 FTE, or so much thereof as may be necessary,
for the implementation of this act.
SECTION 3. Effective date. This act shall take effect
July 1, 1991.
SECTION 4. Safety clause. The general assembly hereby
